Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must declare whether it or its relevant representatives have been convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour or other forms of human trafficking. The declarations also cover tax and social security contribution arrears, insolvency or liquidation, creditor arrangements, suspended business activities, serious professional misconduct, competition-distorting agreements, conflicts of interest, involvement in preparing this procurement, and significant or persistent failures under previous public contracts. They also cover false or misleading information, failure to provide required information or documents, and attempts to obtain confidential information or improperly influence the contracting authority. National grounds include enabling the employment of a foreign national without a legal basis or in breach of employment conditions, being subject to international sanctions, local tax arrears owed in the contracting authority’s location, and conviction for tax offences. Where relevant, the bidder must describe the circumstances and any measures taken to demonstrate its reliability. The notice states that tax-debt evidence is not issued for certain debts below EUR 100, or where payment has been rescheduled; foreign bidders are assessed under the rules of their country of establishment.

Qualification criteria and exclusion grounds

The bidder’s net turnover in the last three financial years (2024–2026) must be at least EUR 200,000, excluding VAT. If requested and the information is not already available to the contracting authority, the successful bidder must provide relevant extracts from its annual accounts or equivalent evidence. During the 36 months preceding the start of the procurement, the bidder must have completed at least three contracts with legal entities for the sale of mobile phones and/or tablets. Each contract must have had a value of at least EUR 10,000 excluding VAT. If requested, the bidder must provide a list stating each customer, a contact person and their contact details, a brief description of the contract, its performance period and value, and the procurement reference number where applicable. The bid must include the participation declaration and bidder confirmations (Form 1). The bidder must provide a copy of the manufacturer’s confirmation that it is an authorised reseller of the offered mobile phones in Estonia, its DEP reseller ID for adding device information to the Ministry’s Apple Business Manager environment, and a link to or upload of the manufacturer’s complete specification for each device type. Joint bidders must appoint an authorised representative and submit the relevant power of attorney (Form 3). A person submitting the bid must be authorised to represent the bidder; otherwise, a power of attorney (Form 2) is required. The bid must comply with the procurement documents; conditional bids are not permitted. Any claimed equivalence must be explained and supported by evidence submitted with the bid. The price must follow the required structure and include all costs and taxes payable under the contract, including purchase and buyback costs. The bidder must identify and justify any information claimed as a trade secret; the bid price and evaluation-related figures may not be designated as trade secrets. The bidder must provide a warranty effective from delivery for at least two years, or for any longer period specified in the relevant compliance condition. It must cover repairs, a replacement device during warranty repairs, battery defects and compliance with the contract requirements without additional charges. The bidder must declare REACH candidate-list substances present above 0.1% by weight in the product and specified accessories and provide evidence of their presence or absence. For reuse and recycling of retired devices, the bidder must describe collection, confidential handling of data carriers and data deletion, and dismantling for recycling or disposal. The service must comply with Directive 2012/19/EU. If the bidder is not affiliated with a producer responsibility organisation, it must provide evidence of cooperation with an authorised waste handler or, if handling waste itself, an environmental permit for waste management.
