Compliance requirements
A bidder may be excluded if, within the last five years or while an exclusion period remains in force, the bidder or a person in its management, supervisory or representative roles has a final conviction for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. The grounds also include enabling the unlawful employment of a foreign national, including breaches of employment conditions or payment below the statutory wage, and entering into the contract would breach an international or Estonian government sanction.
Exclusion grounds include unpaid taxes or social security contributions in Estonia or in the bidder’s country of establishment. Under the notice, the threshold is EUR 0; the stated information explains that a tax-debt certificate is not issued for tax debt below EUR 100 (excluding interest not determined by an administrative act) or where payment has been deferred. Where applicable, the bidder may provide evidence of measures taken to restore its reliability, if this is permitted for the procurement.
