Compliance requirements
The tenderer must declare whether it, or a person authorised to represent, manage or control it, has a relevant final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. Exclusion may also apply where the tenderer has failed to pay taxes or social security contributions, has suspended its business, has an unmanageable conflict of interest, participated in preparing the procurement in a way that distorts competition, or seriously or repeatedly breached a previous contract resulting in early termination, damages or comparable sanctions. Other grounds include submitting false information, withholding required information or documents, improperly seeking confidential information or influencing the procurement decision, enabling unlawful employment of a foreign national, and being subject to an international sanction or entering into a contract that would breach one. Tax debts below EUR 100 or debts whose payment has been rescheduled are treated as described in the tender-pass document. Where permitted, the tenderer may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
No separate financial, experience or professional-capacity qualification thresholds are specified in the provided documents. The tenderer must confirm that its bid complies with the procurement documents; conditional bids are not permitted. Where bidders submit a joint bid, they must appoint an authorised representative and include the power of attorney. The tenderer must identify any trade secrets in the bid and explain why the information qualifies; bid prices and evaluation-related figures may not be designated as trade secrets. Where equivalence is relied upon, it must be explained and supported by evidence. The tenderer must confirm that it will not engage a subcontractor subject to replacement under the applicable rules. For procurements at or above the international threshold, the tenderer must also confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or established in Russia, entities more than 50% owned by them, or persons acting on their behalf or under their direction. The tenderer must confirm that any goods offered are not subject to international sanctions and do not originate from sanctioned regions. No award criteria or scoring method are specified in the provided documents.
