Compliance requirements
The bidder may be excluded if it or its relevant managers, supervisory-body members or representatives have a qualifying conviction within the previous five years, including for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Grounds also include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, creditor arrangements, court or liquidator administration, or suspended business activity; serious professional misconduct; competition-distorting agreements; an unresolved conflict of interest or an unfair advantage arising from involvement in preparing the procurement; and significant or repeated breaches of earlier contracts resulting in early termination, damages, price reductions or penalties. Exclusion may also follow from breaches of environmental, social or labour obligations, false or misleading information, failure to provide required information or documents, or attempts to improperly influence the procurement or obtain confidential information. National grounds include enabling unlawful employment of a foreign national, being subject to international sanctions, and certain tax offences. The bidder must not have a tax or social security debt; the notice describes a certificate exception where the debt is below EUR 100 or payment has been deferred. Where permitted, the bidder may submit evidence of measures taken to restore its reliability.
