Compliance requirements
The bidder must declare whether it or its relevant representatives have, within the applicable period, been convicted of criminal offences including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or human trafficking. The grounds also cover failure to pay taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency or similar situations; serious professional misconduct; agreements intended to distort competition; unresolved conflicts of interest; involvement in preparing this procurement that creates an unavoidable competitive advantage; and serious or repeated breaches of earlier public contracts.
A bidder may also be excluded for providing false information, withholding required information or documents, or improperly influencing the contracting authority or seeking confidential information. National grounds include enabling the unlawful employment of a foreign national, being subject to international sanctions, local tax debt and convictions for tax offences. Where relevant, the bidder must describe the circumstances and any measures taken to demonstrate its reliability. Tax or social contribution arrears may be addressed through payment or a binding payment arrangement, including applicable interest and penalties.
