Compliance requirements
Exclusion grounds include final convictions within the previous five years, or an exclusion period still in force, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or other forms of human trafficking. These grounds apply to the bidder and relevant members of its management, supervisory or governing bodies, and persons authorised to represent, make decisions for or control it. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
A bidder may also be excluded for unpaid taxes or social security contributions. The notice specifies a threshold of EUR 0; however, the stated national rules provide that a tax-debt certificate is not issued for debt below EUR 100, excluding interest not determined by an administrative act, or where payment has been deferred. The bidder may confirm that the debt has been paid or that a binding payment arrangement has been made. Further grounds include enabling a foreign national to work without legal grounds or in breach of employment conditions, and being subject to an international or Estonian government sanctions measure that would make awarding the contract unlawful.
