Compliance requirements
The bidder must declare whether it, or a member of its administrative, management or supervisory body, or a person authorised to represent or control it, has been convicted by a final judgment within the last five years, or remains subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
The bidder may be excluded for unpaid taxes or social security contributions. The stated threshold is EUR 0; the notice explains that, under Estonian rules, a tax-debt certificate is not issued where the relevant debt is below EUR 100, excluding interest not established by an administrative act, or where payment has been rescheduled. Foreign bidders are assessed under the rules of their country of establishment.
Mandatory exclusion grounds also include enabling a foreign national to work without a legal basis or breaching the conditions for a foreign national’s employment in Estonia, and the award of the contract to a bidder subject to an international or Estonian Government sanction. The bidder must confirm that entering into the contract would not breach an applicable international sanction; the contracting authority may request further evidence where there are justified doubts.
Qualification criteria and exclusion grounds
The bidder must be entered in the business register of its country of establishment.
The bidder’s average annual turnover for the financial years from 1 January 2023 to 31 December 2025 must be at least EUR 60,000.
During the 36 months before the procurement began, the bidder must have properly completed at least one contract for the design of a building renovation to at least preliminary-design stage, including work to improve the building’s energy efficiency. The bidder must provide details of the service, its value and completion period, and the client.
The bidder must have at least one specialist responsible for architectural design, holding a professional qualification as an authorised architect, level 7, or an equivalent qualification permitting architectural design of the building covered by the contract. The bidder must provide the specialist’s name, qualification and level, and certificate number or other evidence of qualification.
The bid must meet the tender documents and follow the prescribed price-submission structure. Conditional bids are not permitted. Any claimed equivalence must be explained and supported with evidence where necessary. Joint bidders must appoint an authorised representative and include the authorisation with the bid. The bidder must identify and justify any information claimed as a trade secret; the bid price and other specified evaluation-related figures may not be treated as trade secrets.
