Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must declare whether it or its representatives have relevant final convictions within the previous five years, including for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. The contracting authority also checks for unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation or comparable situations; serious professional misconduct; agreements intended to distort competition; conflicts of interest or involvement in preparing the procurement; serious failures under previous contracts; false or misleading information, withheld information, failure to provide requested documents, or attempts to obtain confidential information or improperly influence decisions. National exclusion grounds also cover enabling a foreign national to work without a lawful basis, international sanctions, certain tax offences, local tax debt where stipulated in the tender documents, and restrictions on participation based on the bidder’s place of establishment. For tax debt, the notice states a threshold of EUR 0, while noting that a debt below EUR 100 or a debt whose payment has been deferred does not result in a tax-debt certificate under the applicable Estonian rules. Where legally available, the bidder may describe measures taken to restore its reliability. First-tier subcontractors are checked for exclusion grounds; second- and subsequent-tier subcontractors are not checked under these conditions. The tender documents require the bidder to confirm that it will not engage a subcontractor who must be replaced under the applicable rules.

Qualification criteria and exclusion grounds

The bidder’s total net turnover must have been at least EUR 1,000,000 in each of the last three completed financial years. The bid must identify the following responsible project managers: - For road works, a project manager holding at least the non-initial Diploma Road Engineer qualification, EKR/EQF level 7, specialising in road construction and maintenance or roads, with the selected competence in construction management, or an equivalent qualification. - For district-heating pipeline works, a project manager holding at least the Diploma Thermal Energy Engineer qualification, EKR/EQF level 7, specialising in district heating and cooling systems, with the selected competence in construction management, or an equivalent qualification. Qualification documents must be provided upon request, including for personnel engaged as subcontractors. During the 60 months before the procurement began, the bidder must have properly completed at least one contract for construction works on a publicly used road (excluding road maintenance) that included at least 1,500 m² of paving in urban conditions. It must also have properly completed at least one contract for construction or reconstruction of at least 100 linear metres of pre-insulated pipeline with a steel service pipe of at least DN125, complying with standards EVS-EN 253, 448, 488 and 489 or equivalent. The bid must describe each reference, state the work period and provide the client’s representative’s contact details; client confirmations may be requested. The bid must be unconditional and comply with the tender documents. Prices must follow the prescribed structure, show unit prices in euros excluding VAT to two decimal places, and include all costs needed to perform the contract. The price schedule must be fully completed without changes, added conditions or blank entries. Zero or negative unit prices are not permitted. The bidder must confirm that neither it nor persons acting on its behalf engaged in corrupt conduct in this procurement. If subcontracting is planned, the bidder must provide the required subcontractor details and confirm that it will not use a subcontractor who must be replaced under the applicable rules. Joint bidders must submit an authorisation appointing their representative. The bidder must identify persons authorised to represent, decide for or control it who are not visible to the contracting authority in the relevant register, including their names and personal identification codes, or confirm that there are no such persons. Any claimed trade secrets must be identified and justified; prices and evaluation-related figures cannot be classified as trade secrets.
