Compliance requirements
The exclusion grounds cover final convictions within the previous five years, where the exclusion period is still in force, of the bidder or its relevant representatives for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. They also cover unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business activity; serious professional misconduct; agreements intended to distort competition; conflicts of interest that cannot otherwise be remedied; involvement in preparing the procurement that creates an unremediable competitive advantage; early termination or sanctions for serious or repeated breaches of previous contracts; false or misleading information, failure to provide required information or documents, or improper attempts to influence the procurement or obtain confidential information; and breaches of environmental, social or labour obligations. National grounds include enabling a foreign national to work without a legal basis or in breach of employment conditions, being subject to international sanctions, and certain tax-related convictions. For Estonian tax debts, the notice explains that a certificate is not issued where the relevant debt is below EUR 100 or payment has been rescheduled; foreign bidders are assessed under the law of their country of establishment. Where legally available, the bidder may provide evidence of remedial measures to restore its reliability.
