Compliance requirements
The bidder must confirm that neither the company nor its representatives or controlling persons are subject to exclusion grounds, including final convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or unlawful child labour and human trafficking. The bidder must not have outstanding tax or social security payment obligations, bankruptcy, insolvency, liquidation or comparable proceedings, a suspended business activity, serious professional misconduct, anti-competitive agreements, an unresolvable conflict of interest, improper involvement in preparing the procurement, serious or repeated breaches of previous public contracts, or a history of submitting false or incomplete information or failing to provide required evidence.
The bidder must also confirm compliance with the national exclusion grounds concerning unlawful employment of foreign nationals, international sanctions and convictions for tax offences. The bidder may be required to provide information and evidence concerning any such circumstances and, where permitted, evidence of measures taken to restore its reliability. The bidder must confirm that it will not use subcontractors or suppliers exceeding 10% of the contract value that are Russian nationals, residents or entities established in Russia, entities more than 50% owned by them, or persons acting on their behalf or under their instructions. The offered goods must not be subject to international sanctions or originate from sanctioned regions. The bidder must not engage a subcontractor who would have to be replaced under the applicable procurement rules.
Qualification criteria and exclusion grounds
The bidder’s net turnover in the sale of sound equipment must have been at least EUR 300,000 in each of the last three completed financial years preceding the start of the procurement. The bidder must also have completed at least one contract during the 36 months preceding the start of the procurement covering the sale and installation of sound equipment, with a value of at least EUR 250,000 excluding VAT. The offer must include the buyer’s name and contact details, a description of the contract, the performance period and the contract value.
The bidder must submit detailed technical descriptions and product sheets for the proposed products. The products must have a warranty of at least three years from handover. The offer must comply with the procurement documents; where an equivalent solution is offered, its equivalence and supporting evidence must be provided. If submitting a joint bid, the bidders must appoint an authorised representative and include the relevant power of attorney. The bidder must also identify and justify any business secrets in the offer.
