Compliance requirements
The tenderer must declare whether it or persons with management, supervisory or representation powers have relevant convictions within the past five years, including for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business activities; serious professional misconduct; breaches of environmental, social or labour obligations; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement where this creates an advantage that cannot otherwise be remedied; and serious or repeated breaches of previous contracts resulting in early termination, damages, price reductions or penalties. Grounds also include false or misleading information, failure to provide required information or documents, and attempts to improperly influence the procurement or obtain confidential information. National grounds cover enabling unlawful employment of a foreign national, being subject to international sanctions, and convictions for tax offences. Where a ground applies, the tenderer may provide evidence of remedial measures if permitted by law or the procurement documents.
Qualification criteria and exclusion grounds
The tenderer must submit its offer using the form in Annex 1, complete all fields concerning the proposed products and required confirmations, and demonstrate compliance with the technical specification. The offer must include manufacturer’s product information in Estonian or English and the required supporting documents, such as technical data sheets, declarations of conformity and certificates. Samples must be submitted in the quantity and manner specified in Annex 1, no later than the tender submission deadline; late or non-compliant samples make the offer non-compliant. The price must follow the structure in the designated pricing sheet; if its total differs from the total in Annex 1, the Annex 1 total applies. Conditional offers are not permitted.
The tenderer must confirm compliance with the procurement documents and provide evidence of equivalence where relevant. Joint tenderers must appoint an authorised representative and include the relevant power of attorney. Any information identified as a trade secret must be justified; the price and other specified evaluation figures may not be treated as trade secrets. The tenderer must confirm that the goods are not subject to international sanctions and do not originate from sanctioned regions. For procurements to which the relevant EU sanctions regulation applies, the tenderer must also confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers who are Russian nationals, residents or entities established in Russia, entities more than 50% owned by them, or persons acting on their behalf or under their direction. No separate award criteria are specified in the provided document text.
