Compliance requirements
A tenderer may be excluded for relevant final convictions of the company or its representatives, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. The grounds also cover breaches of tax or social-security payment obligations, environmental, social or labour-law obligations, bankruptcy, insolvency, liquidation, creditor arrangements, similar financial situations, administration of assets by a liquidator or court, and suspension of business activities.
Other grounds include serious professional misconduct, agreements with other operators intended to distort competition, an unmanageable conflict of interest, involvement in preparing this procurement that creates an unpreventable competitive advantage, and serious or persistent breaches of previous contracts resulting in early termination, damages or comparable penalties. Exclusion may also apply for false or misleading information, withholding required information or documents, improper attempts to influence the procurement or obtain confidential information, enabling the unlawful employment of a foreign national, relevant international sanctions, and convictions for tax offences. The notice specifies a zero-euro threshold for tax and social-security debts; it also notes that, under Estonian rules, a tax-debt certificate is not issued where the debt is below EUR 100 or payment has been deferred. Where permitted, the tenderer may provide evidence of remedial measures restoring its reliability.
