Compliance requirements
The bidder will be excluded if the bidder, or a person authorised to represent, manage, supervise or control it, has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling the unlawful employment of a foreign national or breaches of the conditions for employing foreign nationals in Estonia, including paying below the statutory wage rate; or unlawful use of child labour or human trafficking. Exclusion also applies where the bidder has outstanding national tax, duty or environmental-charge debts, or tax or social security contribution debts under the law of its country of establishment, or where awarding the contract would breach an international or Estonian Government sanction.
The bidder must confirm that none of these grounds applies. Foreign bidders must provide the relevant criminal-record notice or equivalent document and a certificate from the competent authority confirming the absence of tax-related grounds. Where such documents are not issued or do not cover all required matters, equivalent statements or evidence may be submitted. Sanctions are checked on the basis of the bidder’s confirmation, although the contracting authority may request further information or evidence if it has justified doubts.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register or an equivalent register in its country of establishment where registration is required by law. Bidders established in Estonia are checked by the contracting authority; foreign bidders must provide a valid registration certificate or equivalent evidence.
The bidder and/or its subcontractor must have completed at least one significant contract during the 36 months preceding the start of the procurement for technical maintenance, repair and fault prevention relating to frequency converters. The contract must have had a value of at least EUR 100,000 excluding VAT. The values of several contracts may not be combined to meet this threshold. Only services properly performed and accepted by the client during the reference period count. Details must be provided using the contract list form, including the contract and client names, value excluding VAT, performance period, work description and the client contact person’s details. The contracting authority may verify the information with the client.
The bidder and/or its subcontractor must also have completed at least one significant contract during the same 36-month period for technical maintenance, repair and fault prevention of frequency converters with a capacity exceeding 100 kW. The contract list form for converters above 100 kW must include the contract, client, value, period, work description and client contact details. Only services properly performed and accepted during the reference period count.
The bidder and/or its subcontractor must provide qualified personnel responsible for the work, including an electrical work supervisor with Class A competence and an electrical work supervisor with Class B competence, or equivalent or higher competence. A person supervising the work must hold a valid certificate for completing “VFD basic service and repair” training issued by at least one of these equipment manufacturers: ABB, Mitsubishi, Schneider Electric, Siemens, Converteam or Grundfos. Submit the responsible persons list and copies of documents proving their qualifications and competence. A foreign bidder whose documents were not issued under Estonian regulations must provide equivalent documents issued under the laws of its country and undertake to submit, within one month after signing the contract, confirmation of the responsible person’s qualifications and competence issued by the Estonian Consumer Protection and Technical Regulatory Authority.
If the bidder relies on another entity’s resources, it must identify that entity and demonstrate that the resources will be available for contract performance. An entity whose experience or right to operate is relied upon must itself perform the part of the contract for which that experience or right is required.
For a joint bid, the joint bidders must appoint an authorised representative and submit an authorisation. The bid must comply with the procurement documents; conditional bids are not permitted. Prices must follow the prescribed structure, and the costs must also be set out in the calculation form, consistently with the values entered in the procurement system. If an equivalent solution is offered, provide an explanation and sufficient evidence to allow the contracting authority to assess compliance. Identify and justify any trade secrets; prices and other numerical figures used in evaluating the bid may not be designated as trade secrets. The bidder must disclose known circumstances that could indicate a conflict of interest or an unfair competitive advantage and provide an explanation where applicable. No specific award criterion or scoring method is stated in the supplied documents.
