Compliance requirements
A bidder will be excluded if it, or a member of its administrative, management or supervisory body or a legal or contractually appointed representative involved in the procurement, has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorist offences or related conduct, money laundering or terrorist financing; enabling the unlawful employment of a foreign national; or unlawful child labour or human trafficking. A bidder will also be excluded if it, or a member of its administrative, management or supervisory body, is subject to an international sanction. The contracting authority may also exclude a bidder on any of the grounds set out in § 95(4) of the Estonian Public Procurement Act.
A bidder with a tax, payment or environmental charge debt under Estonian law, or tax or social security contribution debt under the law of its country of establishment, will be excluded. The contracting authority checks the tax-debt status of bidders registered in Estonia. A foreign bidder must, if additionally requested and the information cannot be verified from public registers, provide a certificate from the competent authority in its country of establishment confirming that the relevant debts do not exist. Each member of a joint bid must confirm that no exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder, or the joint bidders collectively, must have properly performed at least two indoor cleaning service contracts during 1 November 2023–31 October 2026, each worth at least EUR 10,000 excluding VAT. Ongoing contracts count if the value of services demonstrably provided during that period exceeds the minimum amount. Contracts must not have ended because of the bidder’s breach or failure to fulfil its contractual obligations. The bidder must submit a list of its significant indoor cleaning service contracts using Form KII; the document refers to contracts from the last two years for this list.
The bid must include a service description covering at least the organisational structure for delivering the cleaning service, cleaning methods, cleaners’ qualifications and the cleaning products to be used. It must also include a written confirmation that the cleaning products do not contain substances listed in the technical specification above the permitted concentrations and are environmentally friendly.
The bid price must follow the structure specified in the pricing form. The bidder must confirm that the bid complies with the procurement documents; conditional bids are not permitted. The bidder must also submit Form PI and identify and justify any information claimed as a trade secret. The price and price components, and other numerical indicators used to evaluate service bids, may not be designated as trade secrets. No specific award criteria are stated in the provided documents.
