Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder may be excluded if it, or a person authorised to represent, manage or control it, has a relevant conviction within the last five years or remains subject to an exclusion period for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Other grounds include unpaid taxes or social-security contributions; bankruptcy, insolvency, liquidation, suspended business or comparable proceedings; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unremediable competitive advantage; or serious or repeated failures under a previous contract resulting in early termination, damages, a price reduction or a penalty. Exclusion may also apply for breaches of environmental, social or labour obligations; false or misleading information, withholding required information or failing to provide requested supporting documents; attempts to improperly influence the procurement or obtain confidential information; enabling unlawful employment of a foreign national, including paying below the legally required wage; being subject to an international sanction; or conviction for a tax offence. For tax and social-security debts, the stated threshold is zero, but the notice explains that Estonian tax debt below EUR 100 or debt whose payment has been deferred does not result in a tax-debt certificate being issued. Where legally available and provided for in the procurement, the bidder may submit evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The provided documents do not specify financial-capacity or previous-experience thresholds. The bidder must submit the completed technical compliance form I, filling in every field and providing enough technical information to demonstrate that the offered furniture meets the procurement documents, including the technical specification. The offer must be unconditional and comply with the procurement documents; where equivalent products or evidence are used, their equivalence must be explained and supported with evidence. Joint bidders must appoint an authorised representative and provide a power of attorney. The bidder must identify and justify any information claimed as a trade secret; prices and other specified evaluation-related figures may not be treated as trade secrets. The bidder must confirm that the furniture is not subject to international sanctions and does not originate from sanctioned regions. For procurements to which the EU restriction applies, the bidder must also confirm that it will not engage, for more than 10% of the contract value, subcontractors or suppliers that are Russian citizens, residents or entities established in Russia, are more than 50% owned by such persons or entities, or act on their behalf or under their direction. The wood used in the furniture must be legally harvested; evidence of origin, such as an FSC certificate or a FLEGT or CITES licence, must be provided upon delivery. The bidder must declare REACH Candidate List substances present in the product or any component or material above 0.1% by mass, and provide evidence upon delivery of their presence or absence. Furniture must be capable of being dismantled with hand tools and repaired or have parts replaced by an untrained person; dismantling and repair instructions must be delivered with the furniture. The warranty must last at least two years from delivery, cover repairs and a replacement product during warranty repairs, and involve no additional charges; the buyer may require a longer period, as specified in the relevant tender documents. Spare parts or functionally equivalent components must be available for at least two years after delivery. Price or other award criteria are not specified in the provided documents.
