Compliance requirements
The European Single Procurement Document requires bidders to declare whether grounds for exclusion apply to the bidder or relevant persons in its management, control or representation. These include final convictions within the preceding five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking; unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, suspended business activity or comparable proceedings; serious professional misconduct; agreements intended to distort competition; unmanageable conflicts of interest or an unfair advantage from involvement in preparing the procurement; significant or repeated breaches of previous contracts resulting in early termination, damages or comparable sanctions; false or misleading information, withholding information, failure to provide requested documents, or improper attempts to influence the procurement or obtain confidential information; and breaches of environmental, social or labour obligations. National grounds also cover enabling the unlawful employment of foreign nationals, international sanctions, and convictions for tax offences. The tax-debt information notes that an Estonian tax-debt certificate is not issued where the relevant debt is below EUR 100 or payment has been deferred. Where applicable and permitted, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
No specific financial-capacity, turnover, experience or personnel qualification thresholds are stated in the provided documents. Bidders must, however, meet the requirements for the lot or lots they bid for:
- Offer every product listed for each selected lot and show compliance with the technical specifications in Appendix 1. Provide manufacturer-issued technical descriptions, instructions for use and other supporting product information in Estonian or English. Explain any company-specific terminology.
- Products must have CE marking and comply with applicable EU regulations. Submit copies of the relevant conformity certificates or declarations; clearly mark the offered products if they appear among other products in a certificate or declaration. Equivalent products may be offered, with an explanation and supporting evidence.
- Submit the participation declaration and, for a joint bid, the joint bidders’ authorisation and confirmation of joint and several liability using the specified forms.
- Submit product samples as specified in Appendix 2, except for products supplied to Tartu University Hospital during the 24 months before publication of the contract notice. Samples must be in original packaging and labelled with the product code or reference number, product name and lot number. Deliver or post them to the specified address by the bid deadline; samples will not be returned.
- Provide product names, codes, unit prices and the total price for each lot in the required spreadsheet and price form. Prices must include all costs of delivery and unloading at the hospital’s Women’s Clinic and are final, with no additional charges.
- Confirm that the offered goods are not subject to international sanctions or from sanctioned regions. For procurements above the international threshold, also confirm that restricted Russian-linked subcontractors or suppliers will not account for more than 10% of the contract value.
The provided documents do not specify the award scoring method or detailed item quantities; consult the tender documents for the complete technical specifications and evaluation details.
