Compliance requirements
The tenderer may be excluded if it, or a person in its management, supervisory or control bodies or authorised to represent or control it, has a relevant final conviction within the last five years, or remains subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. Where applicable, the tenderer may provide evidence of measures taken to restore its reliability.
Exclusion grounds also include failure to pay taxes or social security contributions, suspension of business activities, and serious or repeated breaches of a previous public contract that resulted in early termination, damages, a price reduction or a contractual penalty. A tenderer may also be excluded for enabling a foreign national to work without a legal basis or in breach of employment conditions, including payment below the statutory rate; entering into the contract in breach of an international or Estonian government sanction; or being ineligible to submit a tender under a restriction based on the tenderer’s place of establishment or residence. The notice sets the tax and social contribution arrears threshold at EUR 0 and notes that, under Estonian rules, a tax debt certificate is not issued for arrears below EUR 100 or where payment has been rescheduled.
Qualification criteria and exclusion grounds
The tenderer’s net sales revenue for the last three completed financial years must total at least EUR 30,000. Where a tenderer relies on another entity’s resources, it must provide that entity’s tender passport and, if requested, demonstrate that the entity has agreed to make its resources available and that they will be used to perform the contract. Each member of a joint tender must submit a tender passport.
Joint tenderers must appoint an authorised representative and include the authorisation in the tender. The tender must be unconditional and confirm compliance with the procurement documents. The price must follow the structure specified in the pricing worksheet. The tenderer must identify and justify any information claimed as a trade secret; the price and other specified evaluation-related figures may not be treated as trade secrets.
Submitting a tender requires an inspection of the contract sites. The inspection is scheduled for 10 November 2026 at 09:00, starting at the Harju Street green area and continuing to Tammsaare Park and Tondiraba Park; tenderers must arrange their own transport between sites. Registration is required by the stated deadline of 9 November 2027 at 14:00 by email to anu.otsma@kadriorupark.ee. A tenderer that does not attend the inspection at the appointed time may not submit a tender. The tenderer must also confirm that it and those acting on its behalf have not engaged in corrupt conduct in this procedure. No specific award criteria are stated in the provided materials.
