Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The tenderer may be excluded for relevant convictions of the company or its representatives within the previous five years, or while an exclusion period remains in force, involving participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour and human trafficking. Where permitted, the tenderer may provide evidence of measures taken to restore its reliability. Other grounds include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, an arrangement with creditors, administration of assets or suspended business activity; serious professional misconduct; agreements intended to distort competition; an unresolvable conflict of interest; involvement in preparing this procurement that creates an unfair competitive advantage; and serious or persistent breaches of previous contracts resulting in early termination, damages, price reduction or comparable sanctions. Exclusion may also apply for false or misleading information, failure to provide required information or documents, or improper attempts to influence the procedure or obtain confidential information. National grounds include enabling the unlawful employment of a foreign national, being subject to applicable international sanctions, relevant tax offences, local tax arrears at the contracting authority’s location where provided for, and a restriction on participation based on the tenderer’s place of residence or establishment. The tenderer must provide the requested declarations and information for these checks; where permitted, reliability-restoration measures may be presented.

Qualification criteria and exclusion grounds

For both lots, the tenderer must have completed at least one contract during the 36 months preceding the start of the procurement that included a utility-network preliminary design covering water supply, sewerage and electrical installations. The tender passport must provide the contract description, award and completion dates, value and client details, including a contact person’s name, email address and telephone number. At the contracting authority’s request, further explanations, information or documents must be provided within five working days. For both lots, the person responsible for managing the design work must hold at least the professional qualification of Chartered Water Supply and Sewerage Engineer, Estonian Qualifications Framework level 7, specialising in external water supply and sewerage and with the selected competence of design management, or an equivalent qualification. An initial professional qualification based solely on education is not sufficient. The tender passport must identify the project manager. At the authority’s request, the tenderer must provide qualification evidence; for a qualification obtained abroad, it must provide confirmation from the competent authority that the qualification is recognised as equivalent. Further requested information or documents must be provided within five working days. The tenderer must also comply with the technical descriptions’ requirements for specialists involved in contract performance, including engaging specialists for the relevant disciplines in addition to those used to meet the selection criteria. After contract award, the successful tenderer must provide a list of those specialists and their professional certificates, with supporting evidence where necessary; qualification evidence for the persons responsible for the work must be provided at the authority’s request, including for subcontractors. The tender must be unconditional and confirm acceptance of the procurement documents. For each lot, submit the completed price schedule in the prescribed format, with every required row filled in and no changes or added conditions. Unit prices must be in euros, excluding VAT, to two decimal places; zero and negative unit prices are not permitted. Prices must include all costs necessary for proper performance. The prescribed completed price schedule and payment and time schedule must be submitted. The tenderer must identify any claimed trade secrets and explain the designation; prices and other specified evaluation-related figures may not be classified as trade secrets. The tenderer must confirm its environmental commitments and provide the names and personal identification codes of relevant representatives not discoverable in public registers, or confirm that there are none. Joint tenderers must appoint an authorised representative and provide the power of attorney.
