Compliance requirements
The bidder must declare whether it, or persons in its management, supervisory or representative bodies, are subject to relevant convictions within the previous five years or to a continuing exclusion period. The grounds include participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and the illegal use of child labour or other forms of human trafficking.
Exclusion may also apply for unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, suspended business activity or comparable proceedings; serious professional misconduct; anti-competitive agreements; an unmanageable conflict of interest; involvement in preparing the procurement that creates an irremediable competitive advantage; or serious or repeated breaches of previous contracts resulting in early termination, damages, price reductions or penalties. Grounds also include false or misleading information, withholding required information or documents, and attempts to obtain confidential information improperly. National grounds include enabling the unlawful employment of a foreign national, being subject to international sanctions, and relevant tax offences. For Estonian tax-debt evidence, a debt below EUR 100 or a rescheduled debt is treated as specified in the notice. Where applicable, the bidder may describe measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register under the laws of its country of establishment and hold a valid licence, issued by the Estonian Association of International Road Carriers (ERAA) under the Public Transport Act, to organise paid passenger transport. The contracting authority will check these registrations in the relevant public registers.
During the 36 months preceding the start of the procurement, the bidder must have completed at least one passenger transport contract worth at least EUR 20,000 excluding VAT. The bidder must also have three buses, or a written agreement to acquire or use them for the contract: one with at least 19 seats and two with at least 23 seats each. None may be more than 10 years old during contract performance. The bidder must provide a list of the buses and their registration numbers; the contracting authority may request registration certificate copies or an extract from the Transport Administration.
The bidder must confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers connected to Russian persons or entities as specified in the tender documents. Joint bidders must appoint an authorised representative and provide a power of attorney. The bid must be unconditional, comply with the procurement documents and follow the required price-submission structure. Any claimed equivalence must be explained and supported by evidence. The bidder must identify and justify any trade secrets, but may not classify the bid price or specified evaluation-related figures as confidential. No award criteria or scoring details are stated in the supplied documents.
