Compliance requirements
The bidder must not be subject to grounds for exclusion. These include final convictions within the last 5 years of the bidder or its management, administrative or supervisory body members, procurist, or other person with powers of representation, decision-making or control for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, child labour or human trafficking. Other grounds include outstanding tax or social security contributions, bankruptcy, liquidation, insolvency, an arrangement with creditors, or suspended business activities.
Exclusion may also result from breaches of environmental, social or labour law obligations; serious professional misconduct; anti-competitive agreements; an unresolved conflict of interest or an unfair advantage gained through involvement in preparing the procurement. Relevant grounds also include serious or repeated breaches of a previous public contract resulting in early termination, damages or a penalty; providing false information or failing to provide required information or documents; and improperly obtaining confidential information or influencing the buyer’s decisions. National grounds may also apply, including enabling the employment of a foreign national staying in Estonia without a legal basis, breaches of international sanctions, tax offences and restrictions on participation in the procurement. The stated threshold for tax debt is EUR 0; under Estonian tax rules, debt below EUR 100 is not treated as tax debt, and deferred tax debt is excluded. If an exclusion ground applies, the bidder may submit evidence of remedial measures where permitted by law and the tender documents.
