Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A tenderer may be excluded for specified final convictions involving participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking, including convictions of persons who manage, represent or control the tenderer. The grounds also cover serious breaches of environmental, social or labour-law obligations; serious professional misconduct; agreements intended to distort competition; unmanageable conflicts of interest; improper involvement in preparing the procurement; significant or repeated breaches of earlier public contracts; and false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information or improperly influence the procurement. Exclusion may also apply in cases of unpaid taxes or social security contributions, bankruptcy, insolvency, liquidation, creditor arrangements, administration of assets by a liquidator or court, or suspended business activities. National grounds include enabling a foreign national to work without a legal basis, relevant tax offences, and being subject to international sanctions. The notice also provides for checks concerning local tax arrears and restrictions on participation based on the tenderer’s place of establishment. Where permitted, the tenderer may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The tenderer’s net turnover must have been at least EUR 300,000 in each of the last three financial years completed by the start of the procurement. The tenderer must report turnover for those years in the ESPD. At the contracting authority’s request, supporting evidence such as extracts from the annual accounts must be provided, unless the information is available in public registers. The tenderer must have properly completed at least one sale contract for comparable public-space technology during the 36 months preceding the start of the procurement. The contract must include installation, transport and related work and have a value of at least EUR 100,000 excluding VAT. Work under a contract is counted only to the extent completed during that 36-month period. For supplies under a framework agreement, completed contracts concluded under it may be used as references. The tenderer must describe the reference and provide the value, period, customer and contact details. The tenderer must confirm that the offered goods are new and meet the technical and functional requirements. The tenderer must submit product data sheets or specifications and the completed Appendix 1.1 offer form. Where an equivalent product or solution is offered, its equivalence must be explained and supported with evidence. The offer must follow the prescribed price-form structure, include all unit prices and totals in euros excluding VAT to two decimal places, and include the completed Appendix 2 price form. Every line must be completed; unpriced work, missing totals, zero or negative prices, changes to the form, additional conditions and cross-subsidisation outside the contract are not permitted. Unit prices remain fixed throughout the contract period. The tenderer must confirm acceptance of the tender-document conditions and may not submit a conditional offer. The tenderer must provide the required declarations concerning international sanctions, sanctioned goods and origin, corruption, and participation restrictions. Subcontractors and suppliers covered by the specified Russian-related restrictions may not account for more than 10% of the contract value. Joint tenderers must appoint an authorised representative and submit a power of attorney. Any information claimed as a trade secret must be identified and justified; the price and specified evaluation-related figures may not be classified as trade secrets. The machine-readable notice and supplied text do not specify the award-scoring method; check the official tender documents for it.
