Compliance requirements
A bidder may be excluded for relevant final convictions within the preceding five years involving participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Grounds also include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business activities; serious professional misconduct; agreements intended to distort competition; unresolved conflicts of interest or an unfair advantage arising from involvement in preparing the procurement; and serious or repeated breaches of previous contracts resulting in early termination, damages, price reductions or comparable sanctions. Exclusion may also result from breaches of environmental, social or labour obligations, false or misleading information, withholding required information or documents, improper attempts to influence the contracting authority, or seeking confidential information to gain an unfair advantage. National grounds include enabling the unlawful employment of a foreign national, being subject to applicable international sanctions, specified tax offences, and any restriction on the bidder’s right to participate based on its place of establishment. For tax-debt certificates, the notice explains that debts below EUR 100 or debts whose payment has been rescheduled may not be treated as outstanding for certificate purposes. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must have properly performed at least one comparable electricity sales contract during the 36 months preceding the start of the procurement, with a value of at least EUR 300,000 excluding VAT. The bidder must provide the contract subject, duration, value excluding VAT, and the other party’s details, including its name, registration code and the customer representative’s contact details; for a public procurement contract, provide its reference number.
For the delivery period, the bidder must either hold balance-responsible-party status or have a valid contract with a recognised balance responsible party for open supply and balance management. A bidder that is itself a balance responsible party must state the validity period of its balance agreement with the system operator. Otherwise, it must include a copy of the open-supply agreement or confirmation from the balance responsible party that the agreement is in force for this procurement’s delivery period.
The bidder must have filed a notice of economic activity for electricity sales in Estonia’s register, or hold the corresponding registration or licence required by the law of its country of establishment. The contracting authority will check Estonian registrations in the public register; bidders established abroad must submit documentary evidence.
The offer must accept the procurement documents without conditions. The bidder must state its unit margin for electricity buy-back in EUR/MWh to two decimal places, applicable throughout the framework agreement, and submit prices in the prescribed structure. Joint bidders must appoint an authorised representative and provide the required power of attorney. The bidder must identify any claimed trade secrets and explain the designation; offer prices and other specified evaluation figures may not be designated as trade secrets. The bidder must also confirm compliance with the restriction on involving, for more than 10% of the contract value, certain Russian-linked subcontractors, suppliers or entities whose capacity is relied upon. No specific award-scoring details are stated in the provided documents.
