Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder may be excluded for relevant final convictions within the preceding five years involving participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. The grounds also cover unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements, similar proceedings, administration of assets by a liquidator or court, or suspended business activity; serious professional misconduct; competition-distorting agreements; an unmanageable conflict of interest; improper involvement in preparing the procedure; significant or persistent breaches of previous contracts resulting in early termination, damages, price reductions or penalties; false, misleading or withheld information, failure to provide required documents, or attempts to obtain confidential information or improperly influence decisions. National grounds include enabling the unlawful employment of a foreign national, being subject to applicable international sanctions, and relevant tax offences. The bidder must also declare that it and persons acting on its behalf have not engaged in corruption. For Estonian tax arrears, the stated threshold is EUR 0; however, the tax authority does not issue an arrears certificate where the debt is below EUR 100 or payment has been deferred. Where a ground applies, the bidder may provide evidence of measures taken to restore its reliability where permitted.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least one contract of comparable content during the 36 months preceding publication of the contract notice. The reference must concern building or selling a shelter or shelter components. The bidder must describe the work and its value, its own role and the performance period, and provide the client’s name and contact details as evidence. The bid must comply with the tender documents and may not be conditional. Prices must follow the prescribed structure and be submitted using Annex 2, in euros excluding VAT, to two decimal places. All marked fields must be completed without changing the form or adding conditions, and prices must cover all costs of providing the services described in the documents. For a joint bid, the bidders must appoint an authorised representative and submit their power of attorney. The bidder must identify any business secrets and explain why the information qualifies; prices and other specified evaluation figures may not be treated as business secrets. The bidder must provide the names and personal identification codes of its managers or authorised representatives who are not visible in the procurement register, or confirm that there are none. The bidder must commit to engaging specialists with the qualifications required by the mini-competition invitation and the framework agreement’s technical description, or equivalent specialists, and provide their names and signed confirmations of participation as required by the invitation. Where contract performance involves activities subject to statutory competence or registration requirements, the persons carrying them out must meet those requirements. The bid must include a shelter construction design at the main-design stage, prepared in sufficient detail to verify compliance with the framework agreement’s technical description. Additional construction-related documents must be provided where needed to demonstrate compliance. Where a technical specification refers to a standard, product, source or other specified basis, an equivalent may be offered; the bidder must explain and substantiate equivalence where applicable. The bidder must confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in Russia; are more than 50% directly or indirectly owned by such persons or entities; or act on their behalf or under their direction. The bidder must also confirm that it is not established in Russia or Belarus and does not rely on the resources of an entity established there, and that the offered goods are not subject to international sanctions or from sanctioned regions. The bidder must provide the required price schedule and confirm that neither it nor persons acting on its behalf have engaged in corruption in this procedure.
