Compliance requirements
The grounds for exclusion include final convictions within the previous five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. They also include failure to pay taxes or social security contributions; bankruptcy, insolvency, liquidation, suspended business activity or comparable situations; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest or an advantage gained through involvement in preparing the procurement; serious or repeated breaches of previous contracts resulting in early termination, damages or comparable sanctions; false or misleading information, withholding required information or failing to provide requested supporting documents; and breaches of environmental, social or labour obligations. National grounds also cover enabling the unlawful employment of a foreign national, being subject to international sanctions, and convictions for tax offences. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
No specific financial, experience or other qualification thresholds are stated in the available documents. The bidder must submit an unconditional offer that complies with the tender documents. The technical offer must address every requirement in the technical specification so that compliance can be checked; a simple statement of compliance is insufficient. The bidder must also submit an informative price table for the equipment components and present the total price in the structure specified in the pricing schedule. Any information claimed as a trade secret must be identified and the claim justified; prices and other specified evaluation-related figures may not be designated as trade secrets. The bidder must confirm that the goods are not subject to international sanctions and do not originate from sanctioned regions. It must also confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in Russia, entities more than 50% owned by such persons or entities, or representatives or persons acting on their instructions. In a joint bid, the participants must appoint an authorised representative and provide a digitally signed or signed and scanned power of attorney.
