Compliance requirements

A bidder may be excluded for relevant final convictions involving participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, illegal child labour or human trafficking. The grounds also cover tax or social security payment arrears; bankruptcy, insolvency, liquidation or similar proceedings; suspended business activities; serious professional misconduct; agreements intended to distort competition; conflicts of interest that cannot otherwise be avoided; and involvement in preparing the procurement where an resulting competitive advantage cannot otherwise be remedied. Exclusion may also apply for serious or repeated breaches of previous public contracts resulting in early termination, damages or comparable sanctions; breaches of environmental, social or labour obligations; false or misleading information, withholding required information or failing to submit requested documents; improperly seeking confidential information or influencing the contracting authority; permitting an unlawfully staying foreign national to work; entering into a contract in breach of international or national sanctions; or relevant tax-related offences. Conviction-related grounds generally concern the bidder or persons authorised to represent, manage or control it and convictions within the previous five years, or a continuing exclusion period. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bidder must be entered in the business register of its country of establishment or an equivalent register. The bidder’s net turnover must have been at least EUR 200,000 in each of the last three completed financial years. During the 36 months preceding publication of the contract notice, the bidder must have completed at least one sale and installation of a complete professional sound system suitable for theatre, concerts and conferences, including delivery and configuration. The value of that contract must have been at least EUR 100,000. The bidder must provide the relevant information in the procurement passport. The bid must comply with the tender documents and must not be conditional. Submit the price using the prescribed structure and include the price table provided in the tender documents. Where an equivalent product or solution is offered, explain the equivalence and provide supporting evidence. If the bid is submitted jointly, the joint bidders must appoint an authorised representative and include the power of attorney with the bid. Identify any claimed trade secrets and explain why the information qualifies; price and specified evaluation-related figures may not be designated as trade secrets. The bidder must confirm that it will not involve subcontractors or suppliers connected to the Russian Federation in performing more than 10% of the contract value, as specified in the tender documents, and that the goods offered are not subject to international sanctions and do not originate from sanctioned territories.
