Compliance requirements
A tenderer originating from a third country will be excluded. A third country is a country that is not an EU or European Economic Area member, a party to the WTO Government Procurement Agreement, or a country with which the EU has a reciprocal free trade agreement covering public procurement. The tenderer must state its country of origin, defined as the country in which the company is registered.
A tenderer will also be excluded if it has outstanding state taxes, mandatory contributions or environmental charges, or outstanding tax liabilities or overdue social security contributions under the laws of its country of establishment. Deferred or rescheduled tax debts are acceptable. The contracting authority will verify the absence of tax arrears for tenderers established in Estonia; tenderers established outside Estonia may be asked to provide evidence that they have no outstanding tax liabilities.
Qualification criteria and exclusion grounds
The tenderer’s average annual sales revenue for the last three completed financial years ending before the procurement procedure began must be at least EUR 2,000,000 per year. Tenderers established outside Estonia may be asked to provide signed financial statements or equivalent evidence. They must state the revenue for each of the three years so that the contracting authority can calculate the average.
Within the 60 months before the procurement procedure began, the tenderer must have successfully completed at least two contracts covering the design, manufacture, supply and commissioning of an industrial photovoltaic module recycling line. At least one reference line must have a nominal capacity of at least 60 modules per hour. For each reference, provide a project description, the tenderer’s scope of work, the completion month and year, and the client’s name and contact details. The contracting authority may contact the client to verify the reference. If the tenderer relies on another entity’s capacity or experience, that entity must perform the contract work or services to which that capacity or experience relates.
The tenderer must hold a valid ISO 9001 quality management certificate or an equivalent certification and submit a copy.
The tender must include a comprehensive price offer or bill of quantities showing the proposed solution, equipment specifications, scope of work and pricing structure. Complete the technical requirements form in Annex 1 and provide technical specifications, drawings and any other documents needed to verify the information in that form. The offer must comply with the procurement documents; conditional offers are not permitted. Where equivalence is relied on, explain it and provide supporting evidence. The tenderer must identify any information claimed as a trade secret and justify that claim; the total tender price and other figures used in evaluation may not be classified as trade secrets.
Joint tenderers must appoint an authorised representative from among themselves to handle the procurement and the conclusion and performance of the contract, and provide the relevant authorisation. The tender price must follow the structure specified in the evaluation materials. The tender must remain valid for at least 3 months from the submission deadline.
The warranty must last at least 24 months from commissioning and be valid without an additional service agreement. For faults, the tenderer must provide an initial response within 24 hours of notification by email or telephone and, where needed, perform remote diagnostics. If required, an on-site technician must arrive at the buyer’s production premises within 48 hours of notification. These services are included in the tender price during the warranty period. Exceeding the response or arrival time may incur a penalty of EUR 75 per hour, capped at 3% of the total contract price.
Provide a description of regular maintenance, including recommended frequency and annual costs for five years after acceptance. The annual costs must cover mechanical equipment maintenance and repair, inspection and repair of electrical systems, software updates and troubleshooting when necessary. State the costs in euros excluding VAT; they must remain fixed and unindexed for all five years. This maintenance will be covered by a separate contract and must not be included in the tender price. Warranty defects and failures are covered by the warranty, not by regular maintenance.
The tenderer must ensure and confirm that its primary suppliers and subcontractors involved in manufacturing or installing the equipment follow equivalent environmental, safety and quality-management principles, and must confirm compliance with anti-corruption and anti-bribery principles. State the guaranteed overall material recycling yield and the glass and aluminium fraction purity, each as a percentage by mass, and provide a manufacturer’s or customer’s test report or confirmation from at least one customer using the offered equipment. A customer confirmation must identify the customer and provide contact details, identify the equipment, and state the achieved yield and purity levels. The tenderer must also unconditionally accept the specified payment schedule, payment terms and contractual penalties.
