Compliance requirements

The bidder must declare whether it, or its relevant representatives or management, has a final conviction within the previous five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. The grounds also cover breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, suspended business activity or comparable situations; serious professional misconduct; anti-competitive agreements; conflicts of interest or involvement in preparing this procurement where the resulting distortion cannot otherwise be prevented; and serious or persistent failures under previous contracts, including early termination, damages or comparable sanctions. False or misleading information, failure to provide required information or documents, and attempts to obtain confidential information or improperly influence the procurement decision are also grounds for exclusion. Other grounds include unpaid taxes or social security contributions, enabling a foreign national to work without a legal basis, being subject to an international sanction, having been punished for tax offences, or being ineligible to participate under a restriction based on the bidder’s country of establishment. The notice sets the tax and social contribution debt threshold at EUR 0; under the stated Estonian rules, a tax-debt certificate is not issued for debt below EUR 100, excluding interest not established by an administrative act, or where payment has been rescheduled. Where applicable, the bidder may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bidder’s net turnover in the most recently completed financial year must be at least EUR 300,000. Joint bidders may combine their turnover. If relying on another entity’s financial capacity, the bidder must provide the required information about that entity; it will be jointly liable for the part of the contract supported by its capacity. During the 60 months preceding the start of the procurement, the bidder must have duly completed at least one contract for construction works on a public road that included laying at least 11,000 m² of asphalt concrete wearing course. The bidder must list the relevant contract and, at the contracting authority’s request, provide confirmation from the client that the works were completed properly, including the contract period and the area of wearing course laid. Where another entity’s technical capacity is relied upon, that entity must participate directly in performing at least the part of the contract for which its capacity is used. The bidder must accept the tender conditions, submit an offer only for the requested scope, and not use a subcontractor who must be replaced under the applicable procurement rules. The cost schedule must include prices for every payment item; the bidder may not alter or remove the items or other data specified by the contracting authority. The completed schedule must be submitted as an Excel file, with totals in euros to two decimal places. The bidder must identify any trade secrets in its offer and explain their classification. For a joint bid, a signed authorisation for the joint bidders’ representative and separate ESPD declarations for each joint bidder are required. The bidder must provide the names and personal identification codes of authorised representatives not visible in the relevant business register, or confirm that there are none. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions.
