Compliance requirements

The bidder must confirm that neither it nor any member of its representative, management or supervisory bodies is subject to grounds for exclusion. These include final convictions within the past five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. Compliance with tax and social security payment obligations is also checked. The notice sets the threshold at EUR 0; the tax authority does not issue a tax-debt certificate where the debt is below EUR 100 or payment has been rescheduled. Other exclusion grounds include breaches of environmental, social or labour-law obligations; bankruptcy, liquidation, insolvency or suspended business activity; serious professional misconduct; agreements restricting competition; an unavoidable conflict of interest; involvement in preparing the procurement that gives an advantage; and serious or repeated breaches of previous contracts. The grounds also cover false statements, failure to provide required information or documents, improper influence over the decision-making process or obtaining confidential information, breaches involving the employment of a foreign national without a legal basis to stay in the country, international sanctions, and convictions for tax offences. Where permitted for the procurement, a bidder may provide evidence of measures taken to restore its reliability in relation to certain exclusion grounds.

Qualification criteria and exclusion grounds

For either lot, the bidder must prepare its tender in accordance with the technical specification (Annex 1 to the tender documents) and include descriptions and relevant manufacturer materials, user manuals, certificates or declarations of conformity that demonstrate compliance. The price must be submitted using Form 4 and in the required structure. Throughout the contract, the bidder must provide a staffed maintenance team ready to perform the service. The team must include at least one service engineer who has completed additional training provided by the manufacturer. The bidder must provide the engineer’s name and a certificate proving completion of that training. The bidder must confirm acceptance of all tender conditions and submit the participation application using Form 1. If the person signing the tender is not shown in the register as having authority to represent the bidder, a power of attorney in the prescribed form must be provided. For a joint tender, a power of attorney for the joint bidders must be included. Conditional tenders are not permitted. Any information designated as a trade secret must be justified; the tender price and numerical figures corresponding to the award criteria may not be designated as trade secrets.
