Compliance requirements

The bidder or a member of its administrative, management or supervisory body must not be subject to the statutory exclusion grounds. These include convictions within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activity, money laundering or terrorist financing, and illegal use of child labour or human trafficking. Any exclusion period still in force is also relevant. The bidder must not have unpaid tax or social security contributions in its country of establishment or, where different, in the contracting authority’s country. For Estonian tax debts, a certificate is not issued where the debt is below EUR 100 or payment has been deferred. Exclusion also applies to enabling a foreign national to work while unlawfully staying in the country, or enabling breaches of the conditions for a foreign national’s employment in Estonia, including payment below the required wage. Awarding the contract must not breach an international sanction or a sanction imposed by the Government of the Republic of Estonia. Where applicable, the bidder may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bidder’s average annual turnover for 1 January 2023 to 31 December 2025 must be at least EUR 30,000. During the 36 months preceding the start of the procurement, the bidder must have properly completed at least two contracts for the sale of computer equipment, each worth at least EUR 15,000. The bid must include the completed Annex 2, “Bid Table”. For a joint bid, the joint bidders must appoint an authorised representative and submit a power of attorney. The bid must comply with the procurement documents; conditional bids are not permitted. The price must follow the structure specified for the procurement. Where the bid uses an equivalent to a referenced standard, label or other requirement, the equivalence must be explained and supported with evidence. Products must have a warranty of at least three years from delivery. It must cover repairs and a replacement product during warranty repairs, including battery defects, at no additional charge. The bid must declare any substances on the REACH Candidate List present at more than 0.1% by mass in the complete product and specified accessories, and provide evidence of their presence or absence. This applies to the motherboard and integrated components, display, casings and panels, external keyboard, mouse or touch panel, and external AC and DC cables, including adapters and power banks. The bidder must provide a reuse and recycling service for equipment taken out of use in accordance with Directive 2012/19/EU. The bid must describe collection, confidential handling of storage media and data deletion, and dismantling for recycling or disposal. If the bidder is not affiliated with a producer responsibility organisation, it must provide evidence of cooperation with a licensed waste-management operator or its own environmental permit for waste management. Any information designated as a trade secret must be justified; the bid price and figures corresponding to award criteria may not be designated as trade secrets.
