Compliance requirements
The buyer checks the successful tenderer against the exclusion grounds under section 95(1) of the Estonian Public Procurement Act and may require supporting documents before signing the contract if the information is not freely available to the buyer. The tenderer may be excluded for an unmanageable conflict of interest, participation in preparing the procurement that creates an advantage distorting competition which cannot be remedied by other means, insolvency or liquidation, or serious or persistent breaches of previous public contracts that resulted in termination, withdrawal, a price reduction, damages or a contractual penalty. Exclusion may also apply where the tenderer is not legally entitled to participate under applicable national restrictions on the place of establishment or residence. Where permitted, the tenderer may provide explanations and evidence of measures taken to restore its reliability; the buyer assesses those measures under section 97 of the Act.
Qualification criteria and exclusion grounds
The offer must include the completed training curriculum project using Annex 1 and a training programme using Annex 2. The curriculum must cover all minimum learning outcomes in the technical description and specify assessment methods and criteria for achieving them; the outcomes may be clarified or supplemented but not omitted or reduced. The programme must cover all mandatory topics and, for each module or topic, state the subject and subtopics, learning hours, links to learning outcomes, teaching methods and reasons for their selection, and the trainer. It must also include assessment methods and criteria for all six mandatory learning outcomes, a schedule for two days of contact learning, a summary of learning hours, reasons for the structure and timing, arrangements for assessing and documenting individual results in groups of up to 25 participants, and a list or description of required learning materials. Any independent work must be described with its content, duration, timing, links to learning outcomes and assessment method and criteria; if there is none, this must be stated. Contact learning and any independent work together may total no more than 16 academic hours. Finished learning materials and final assessment tasks are not required with the offer.
The offer must identify all trainers directly involved in contract performance and their roles. The team must include at least one lead trainer and one first-aid trainer; one person may fill both roles if they meet both sets of requirements. Each trainer must have higher education and adult-trainer competencies, demonstrated by at least one of the following: a bachelor’s or master’s degree in andragogy, a valid adult-trainer professional certificate, at least three years of training experience, or evidence of university lecturer attestation. Where the three-year experience route is used, the experience must have been acquired by the contract notice publication date; the five-year limit below does not apply to this evidence.
Within the five years preceding publication of the contract notice in the procurement register, the lead trainer must have delivered at least three adult training courses compliant with the Adult Education Act on topics related to this procurement. The trainer’s own teaching contribution must have been at least 8 academic hours in each course; teaching delivered by other trainers does not count. During the same five-year period, the first-aid trainer must have delivered at least three first-aid courses or taught first aid in at least three courses for adults; no minimum of 8 academic hours applies to each course. The first-aid trainer must also have completed the Estonian Red Cross basic first-aid trainer course or equivalent training.
For each trainer, submit a completed Annex 3 trainer form and evidence of education. The form must provide the trainer’s role, education and work experience, relevant training experience, and the basis for adult-trainer competence with information enabling verification. For each past course, provide its subject, target group, date or period, total duration, the trainer’s own teaching hours and topics. For the first-aid trainer, also state the training title, provider and completion date; for equivalent training, describe its content and explain its equivalence.
The price must follow the structure in the pricing criteria sheet, and the completed fields in Annex 2, the pricing form, must be filled in without changing the buyer’s information or other parts of the form. Conditional offers are not permitted; submission confirms acceptance of the procurement documents. Any claimed trade secrets must be identified and justified, but the price and evaluation-related figures or indicators may not be designated as trade secrets. For a joint offer, submit the prescribed power of attorney and state the size and nature of each joint tenderer’s share of the contract. Price is not identified in the supplied text as the sole award criterion, and no other award criteria are specified there.
