Compliance requirements
The bidder may be excluded if it, or a relevant member of its management or supervisory bodies or representative, has a final conviction within the last five years (or an exclusion period remains in force) for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. Exclusion grounds also include tax or social security contribution arrears, enabling the employment of a foreign national staying unlawfully or breaches of the conditions for employing a foreign national in Estonia, and circumstances in which awarding the contract would violate an international or Estonian government sanction. The tax-debt threshold is stated as EUR 0; the notice notes that a tax-debt certificate is not issued for debt below EUR 100, excluding interest not determined by an administrative act, or where payment has been deferred. A bidder may provide evidence of remedial measures to restore its reliability where the law or tender documents allow this. The bidder must also confirm that it is not established or resident in Russia or Belarus and that the supplied goods are not subject to sanctions or from sanctioned regions.
