Compliance requirements
Exclusion grounds cover convictions of the bidder or members of its administrative, management or supervisory bodies for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, human trafficking or the unlawful use of child labour. In general, this concerns convictions from the last five years or an exclusion period that is still in force. The authority also checks payment of taxes and social security contributions, and whether the bidder is bankrupt, insolvent, in liquidation, has suspended business activities or is in a similar situation.
Other possible grounds include breaches of environmental, social or labour-law obligations; serious professional misconduct; agreements that distort competition; an unresolved conflict of interest; involvement in preparing the procurement in a way that creates an undue advantage; material or repeated breaches of a previous public contract; misrepresentation; failure to provide required information or documents; or improperly obtaining confidential information to gain an advantage. Under Estonian law, checks also cover enabling a foreign national who is unlawfully present in the country to work, compliance with international sanctions, and convictions for tax offences. In certain cases, the bidder may submit evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The ESPD does not set out specific selection thresholds, such as minimum turnover or prior-experience requirements. The following compliance requirements nevertheless apply:
- Submit the participation declaration using Form 1. If the person signing the bid as the bidder’s representative is not listed in the register as authorised to represent the bidder, include a power of attorney using Form 2. For a joint bid, include the joint bidders’ power of attorney appointing an authorised representative.
- The bid must comply with the technical specification. Provide the descriptions needed to assess product compliance, together with manufacturer information, user manuals, certificates, declarations of conformity or other relevant evidence. Any equivalent solution must be explained and supported with evidence.
- Submit the price offer using Form 3. Conditional bids are not permitted; submitting a bid confirms acceptance of the tender-document conditions.
- Products must have a warranty that takes effect upon delivery and lasts at least 2 years. The contracting authority may require a longer warranty; the precise warranty period is specified in the clarification of the compliance requirement. The warranty must cover repairs, a replacement product during warranty repairs and battery defects, without additional charges.
- Identify and justify any information in the bid claimed as a trade secret. The bid price and numerical figures used for evaluation may not be designated as trade secrets.
Bids may be submitted for both lots: desktop computers and monitors.
