Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A tenderer may be excluded if it has outstanding tax, payment or environmental charge arrears under Estonian law, or tax or social security contribution arrears under the law of its country of establishment. The contracting authority may allow a tenderer found to have tax arrears time to pay or arrange a payment schedule. Tenderers originating in countries outside the EU, the EEA, the WTO Government Procurement Agreement (GPA) and countries covered by an EU free-trade agreement that includes public procurement provisions are excluded. The tenderer must state the country in which it is registered.

Qualification criteria and exclusion grounds

No specific financial-capacity, experience or other separate qualification thresholds are stated in the provided document. The tenderer must submit the completed technical compliance form in Annex 1 and a comprehensive priced offer describing the proposed solution, including a product sheet or other description of the tarpaulin covers, the scope of work and the pricing structure. Any proposed equivalence must be explained and supported by evidence where necessary. The offer must comply with the tender documents and may not be conditional. Joint tenderers must appoint an authorised representative and provide a power of attorney. The tenderer must identify any trade secrets in its offer and justify that designation; prices and other specified evaluation-related figures or characteristics may not be designated as trade secrets. The tenderer must accept the payment schedule: 30% after delivery of the tarpaulin cover sets to the buyer’s production facility, and 70% after all specified work has been completed and accepted. The first payment term must be at least 7 calendar days, and each subsequent payment term at least 30 calendar days. The tenderer must also accept the contractual penalties set out in the tender documents and provide at least a 3-year warranty from acceptance for the PVC covering, supporting structure, fixings and installation work, covering defects caused by materials, manufacture or installation. External mechanical damage and door mechanisms may be excluded from the warranty. The detailed technical requirements and contractual penalties must be checked in the tender documents.
