Compliance requirements
The bidder must confirm that neither it nor its management, supervisory or representative persons are subject to relevant final convictions within the past five years, or to an exclusion period still in force, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and other forms of human trafficking. The bidder may describe measures taken to restore its reliability where the applicable rules allow this.
Exclusion may also apply for unpaid taxes or social security contributions. The notice notes that, under Estonian rules, a tax-debt certificate is not issued for a debt below €100 or where payment has been deferred; foreign bidders are assessed under the rules of their country of establishment. Other grounds include enabling a foreign national residing unlawfully to work, including breaches of applicable employment conditions, and a contract award that would violate an international or Estonian government sanction. The contracting authority checks first-tier subcontractors for applicable exclusion grounds.
Qualification criteria and exclusion grounds
The bidder’s total net turnover over the last three financial years completed by the start of the procurement must be at least €100,000. The bidder must appoint a site manager for the construction works who holds at least a level 6 construction engineer qualification, specialising in building construction with competence in managing construction activities, or an equivalent qualification. Provide the person’s details and professional certificate number in the European Single Procurement Document (ESPD) if the information is available in the professional register; otherwise, include a copy of the diploma or professional certificate with the bid.
The bid must include the required documents and forms, and confirm acceptance of all tender-document conditions; conditional bids are not permitted. If the bid is submitted by a representative whose authority does not arise from law, include the prescribed power of attorney. Joint bidders must appoint an authorised representative, submit the prescribed power of attorney and accept joint and several responsibility for contract performance.
Submit the price using Form 7, in euros, both excluding and including VAT, to two decimal places. The price must cover all costs necessary to complete the works, including taxes, fees, overheads, profit and customary necessary works not separately described in the tender documents. Where equivalence is claimed, explain it and provide supporting evidence. If subcontractors are used, state their share as a percentage of the total contract price and provide their consent using the prescribed form; a separate ESPD is required for a subcontractor only where the bidder relies on that subcontractor’s capacity.
