Compliance requirements
A bidder may be excluded for relevant criminal convictions of the bidder or its management, supervisory or representative persons, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Exclusion grounds also include breaches of tax or social security payment obligations; breaches of environmental, social or labour-law obligations; bankruptcy, insolvency, liquidation, creditor arrangements or comparable situations; suspended business activity; serious professional misconduct; agreements or conduct distorting competition; an unresolvable conflict of interest; or involvement in preparing the procurement that creates an unfair advantage that cannot otherwise be prevented.
Grounds also include serious or repeated failures under previous public contracts resulting in early termination, damages, price reductions or penalties; false or misleading information, failure to provide required information or supporting documents, or improper attempts to influence the procurement or obtain confidential information; enabling the unlawful employment of a foreign national; entering into a contract in breach of international or Estonian sanctions; and relevant tax-related criminal convictions. For tax and social security debts, the notice states a threshold of EUR 0 and notes that, under Estonian rules, a tax-debt certificate is not issued where the debt is below EUR 100 or payment has been rescheduled. Where permitted by law or the procurement documents, a bidder may provide evidence of measures taken to restore its reliability.
