Compliance requirements
A bidder must be excluded if the bidder, or a person authorised to represent, make decisions for or control the bidder, has been convicted of participation in a criminal organisation, breach of integrity obligations or a corruption offence, fraud, terrorist offences or related participation or attempted offences, money laundering or terrorist financing, or offences involving unlawful employment of foreign nationals or the unlawful use of child labour or human trafficking. A bidder must also be excluded if it has outstanding state tax, duty or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment.
The contracting authority may exclude a bidder that has seriously or persistently breached an essential term of a previous public contract, resulting in termination, withdrawal, a price reduction, damages or a contractual penalty. It may also exclude a bidder that has provided false information about meeting the qualification requirements or failed to submit required information or additional documents. Companies established in Russia or Belarus are not permitted to participate.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement during the 60 months preceding the start of the procurement. At least one contract must have a value of EUR 40,000 or more, excluding VAT. The bidder must submit a list stating the performance period for each contract, the other contracting party’s details, including a contact person’s telephone number and email address, and the procurement reference number where applicable. Evidence of proper completion must be provided on request unless the contracting authority can obtain it from databases without significant expense.
Before bids are opened, the bidder must have registered in Elektrilevi’s partner portal (EPP) a worker holding valid switching authorisations for the relevant works. For low-voltage works only (0.22–1 kV), low-voltage switching authorisations are sufficient. In other cases, both low- and medium-voltage switching authorisations are required, including where low-voltage work requires switching on the medium-voltage side (over 1–20 kV). The bidder must also have a person designated as responsible for the work operation, registered in EPP before bids are opened, and a person leading electrical works who holds valid A competence and/or a qualification of at least level 6, possesses the relevant proof when bids are submitted, and is registered in EPP before bids are opened.
The bid must comply with all procurement documents; conditional bids or bids with additional conditions are not permitted. The bidder must complete every unit-price field in the prescribed price table and provide the requested information about the contract signatory, proof of signing authority where needed, and the contract-performance contact person. Materials, equipment and goods used in the works, including components, must not originate from or be produced in Russia or Belarus; the contracting authority may request certificates of origin.
