Compliance requirements
The bidder may be excluded for specified convictions involving organised crime, corruption, fraud, terrorism, money laundering or terrorist financing, child labour or human trafficking, including convictions of relevant management or representative persons within the past five years or while an exclusion period remains in force. Other grounds include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements, court or liquidator administration of assets, or suspended business; serious professional misconduct; competition-distorting agreements; an unmanageable conflict of interest; improper involvement in preparing the procurement; serious or persistent failures under previous contracts; false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information or influence the procurement decision. National grounds also cover enabling a person without a lawful basis to work, international sanctions, applicable local-tax arrears, convictions for tax offences and any restriction on the bidder’s right to participate based on its place of establishment. Tax and social-contribution arrears are indicated with a threshold of EUR 0; the notice explains that the Estonian tax authority does not issue an arrears certificate where the debt is below EUR 100 or payment has been rescheduled. Where legally available, the bidder may provide evidence of measures taken to restore its reliability.
