Compliance requirements
A bidder may be excluded if it, or a person authorised to represent, manage or control it, has a relevant conviction within the previous five years or is still subject to an exclusion period for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Exclusion grounds also include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, suspension of business or comparable proceedings; an arrangement with creditors; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unremediable competitive advantage; or serious or persistent failures under a previous contract resulting in early termination, damages or comparable sanctions.
A bidder may also be excluded for breaching environmental, social or labour-law obligations; enabling the unlawful employment of a foreign national or breaching rules on foreign nationals’ employment; being subject to applicable international sanctions; committing tax offences; providing false or misleading information, withholding required information or failing to provide requested supporting documents promptly; or improperly seeking confidential information to influence the procurement or gain an unfair advantage. Tax and social-security debt is assessed under the applicable national rules; the notice states a threshold of EUR 0 and explains that a tax-debt certificate is not issued for arrears below EUR 100 or where payment has been deferred. Where legally available, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bid must confirm acceptance of the tender-document conditions; conditional bids are not permitted. The bidder must submit the completed participation form, the price schedule with the total price for each lot excluding VAT, and the completed goods list and unit prices. If the figures in the goods list differ from those entered in the procurement system, the goods-list figures will apply.
For each offered product, submit the completed technical-description bid form without changing its file format, a detailed technical description, and manufacturer-issued technical information in Estonian or English (such as product information sheets, safety data sheets, registration certificates or evidence of compliance with EN standards) sufficient to verify compliance. Also provide the manufacturer's declaration of conformity where applicable, and an EC/EU certificate or other evidence of conformity where required by law. Equivalent products may be offered, but equivalence must be explained and supported with evidence.
Submit one complete product sample for each offered lot in its original packaging; a sample may be non-sterile but must meet the technical requirements. Label the packaging with the product name, lot number, tender reference and bidder name, and ensure the sample reaches the North Estonia Medical Centre warehouse at J. Sütiste tee 19, Tallinn, before the bid deadline. Late samples make the bid non-compliant; submitted samples will not be returned. For joint bids, appoint an authorised representative and include the joint bidders’ power of attorney. Identify and justify any claimed trade secrets; bid prices and other specified evaluation-related figures cannot be classified as trade secrets.
The bidder must provide evidence of product origin or the location of the manufacturing plant. If the international procurement instrument measure applies, goods originating in China must not exceed 50% of the contract’s total value, and subcontracting to Chinese-origin companies must not exceed 50% of that value. On request, evidence of compliance must be provided no later than completion of the contract; breach may result in a proportionate penalty of 10–30% of the contract value. The bid must also confirm that it does not involve more than 10% of the contract value through subcontractors or suppliers that fall within the specified Russian sanctions restrictions, and that the offered goods are not subject to international sanctions or from sanctioned regions. The notice text does not specify the award-scoring method; check the official tender documents for the applicable evaluation details.
