Compliance requirements
A bidder may be excluded if, within the last five years or while an exclusion period remains in force, it or a person authorised to represent, manage or control it has been convicted of corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking offences, or participation in a criminal organisation. Exclusion grounds also include unpaid taxes or social security contributions, bankruptcy, insolvency or liquidation proceedings, and suspended business activities. The notice sets the arrears threshold at EUR 0; under Estonian tax rules, a tax debt below EUR 100 or a debt whose payment has been rescheduled does not prevent issuance of a tax debt certificate. A mandatory ground applies to enabling a foreign national to work without a legal basis or breaching the conditions for their employment, including paying below the statutory wage rate. A bidder may also be excluded if awarding the contract would violate an international or Estonian government sanctions measure. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
