Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder may be excluded if the bidder or a person in its administrative, management or supervisory body, or authorised to represent, make decisions for or control it, has a final conviction within the last five years (or remains subject to an exclusion period) for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour or other forms of human trafficking. Where permitted, the bidder may provide evidence of measures taken to restore its reliability. Exclusion also applies for unpaid taxes or social security contributions in the bidder’s country of establishment or the contracting authority’s country. The stated threshold is €0; under the Estonian tax rules described in the documents, a tax-debt certificate is not issued for debt below €100, excluding interest not established by an administrative act, or where payment has been rescheduled. Foreign bidders’ tax-debt evidence is assessed under the rules of their country of establishment. A bidder may also be excluded for enabling a foreign national who is unlawfully present to work, or for permitting violations of the conditions for a foreign national’s employment in Estonia, including payment below the statutory wage rate. Exclusion applies where concluding the contract would breach an international or Estonian government sanction. The stated participation restriction also bars bidders established in Russia or Belarus.

Qualification criteria and exclusion grounds

The bidder must meet these qualification and compliance requirements: - Within the 36 months preceding the start of the procurement, it must have completed at least two support-service contracts for Microsoft Dynamics 365 Business Central. For each contract, support must have been provided for at least 12 consecutive calendar months during the 36 months preceding publication of the contract notice, and the support-service value must have been at least €13,000 excluding VAT. The bidder must provide the contract description, dates, value, client and contact details, and, where applicable, the procurement reference number. - The framework agreement team must include four distinct key personnel: at least one project manager; one consultant holding a valid Microsoft Certified: Dynamics 365 Business Central Functional Consultant Associate (MB-800) certificate or equivalent; one payroll/personnel consultant; and one developer holding a valid Microsoft Certified: Dynamics 365 Business Central Developer Associate (MB-820) certificate or equivalent. The bidder must provide their names and relevant qualifications and submit CVs using the prescribed form. The contracting authority may request evidence of the specified certificates and, for personnel who are not the bidder’s employees, a signed commitment to participate in contract performance. - The project manager must have at least three years of IT project-management experience. The consultant and developer must each have at least three years of experience with Microsoft Dynamics 365 Business Central Online. The payroll/personnel consultant must have at least three years of experience with the Palk365 and Personal365 modules and experience implementing, administering or supporting those modules for at least one large client. A large client is an organisation with at least 100 employees as of the last day of at least one calendar quarter during the consultant’s work. Experience is calculated to the nearest month. - The bidder must hold valid Microsoft Solutions Partner for Business Applications status with the Small and Midsize Business Management specialisation. It must also have implemented quality-management and information-security management systems meeting at least the requirements of EVS-EN ISO 9001 and EVS-EN ISO/IEC 27001, respectively, or equivalent standards. The contracting authority may request the relevant certificates or equivalent independent evidence. Reliance on another entity is not permitted for these two management-system requirements; in a joint bid, all joint bidders and any entity relied upon for other qualification requirements must meet them. - The person submitting or signing the bid must be authorised to represent the bidder. A foreign bidder must provide evidence of that authority; if the representative is not listed in the relevant register, a power of attorney is required. Joint bidders must appoint an authorised representative and submit a power of attorney signed by all of them; they are jointly and severally liable for performance. - The bidder must submit the required declarations and documents, including the prescribed team CVs and price table, and provide service unit prices and the bid price in the specified structure. Conditional bids are not permitted. The bid must comply with the tender documents; where an equivalent is offered, its equivalence must be explained and supported by evidence. The bidder must also identify and justify any business secrets, but may not classify the bid price or other specified evaluation-related figures as business secrets. - Participation is limited to bidders, including entities whose capacity they rely on, established in Estonia, another EU Member State, another EEA contracting state or a country party to the WTO Government Procurement Agreement. Bidders established in Russia or Belarus may not participate. The supplied documents do not specify the award criteria; check the official tender documents for details.
