Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder may be excluded if it or a person with relevant management, supervisory or representative powers has a final conviction for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. The grounds also include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation or similar situations; suspension of business; serious professional misconduct; competition-distorting agreements; an unresolved conflict of interest; involvement in preparing the procurement that creates an unremedied competitive advantage; and serious or repeated breaches of earlier contracts resulting in early termination, damages or comparable sanctions. Exclusion may also result from false or misleading information, withholding required information or documents, improper attempts to influence the procurement, or breaches of environmental, social or labour-law obligations. National grounds include enabling the unlawful employment of a foreign national, being subject to an applicable international sanction, tax offences, a local-tax debt where applicable, or lacking the right to participate because of the bidder’s place of establishment. The bidder must confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers who are Russian nationals, residents or established in Russia; are more than 50% owned, directly or indirectly, by such persons or entities; or act on their behalf or under their instructions. A bid may be rejected if the resulting contract would breach applicable international sanctions. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

**Lot 1 – Atlassian licences** - The bidder must hold official authorisation issued by Atlassian to resell software licences in Estonia. The bidder must submit a document confirming this authorisation; the contracting authority will also check Atlassian’s partner directory. - The bid must follow the required pricing structure and include Appendix 3. Prices must be in euros excluding VAT, with unit prices and totals stated to two decimal places. Unit prices must cover all costs required to perform the contract; zero and negative unit prices are not permitted. **Lot 2 – consultation, development and support services** - The bidder must provide at least two Atlassian-certified specialists who will participate directly in delivering the service. At least one must hold the Atlassian Cloud Organization Admin certification, and at least one must hold either the Managing Jira Service Projects for Cloud or Managing Jira Projects for Cloud certification. Copies of both specialists’ certificates must be submitted. - The bid must include Form 1, describing how the specialists meet the experience requirements set out in that form. The supplied document does not state the specific experience thresholds. If a specialist is not directly employed by the bidder, a digitally or handwritten signed confirmation (Form 2) that the specialist will actually participate in contract delivery is required; this form is not required for the bidder’s employees. - Both specialists must be able to advise the contracting authority in Estonian. At least B1-level Estonian proficiency must be evidenced for each service specialist by a copy of a certificate showing completion of an Estonian-medium basic school, upper secondary school, vocational school or higher education institution; a state examination certificate in Estonian as a second language with a result of at least 60% of the maximum score; a B1-level Estonian examination certificate; or a study transcript. - The bid must follow the required pricing structure and include Appendix 3. Prices must be in euros excluding VAT, with unit prices and totals stated to two decimal places. Unit prices must cover all costs required to perform the contract; zero and negative unit prices are not permitted. For either lot, the bid must be unconditional and comply with the tender documents. If an equivalent product or solution is offered, the bidder must explain and substantiate its equivalence. Joint bidders must appoint an authorised representative and submit a power of attorney. The bidder must identify and justify any trade secrets; prices and figures or indicators used to evaluate bids may not be designated as trade secrets. The documents provided do not specify the detailed award-scoring method.
