Compliance requirements

The tenderer may be excluded for relevant final criminal convictions of the company or its management, supervisory or representative persons, including participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, terrorist financing, and child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business; serious professional misconduct; competition-distorting agreements; an unresolved conflict of interest or an unfair advantage arising from involvement in preparing the procurement; serious or repeated failures under earlier contracts, including early termination, damages or penalties; false or misleading information, failure to provide required information or documents, or attempts to improperly influence the procurement or obtain confidential information. National grounds also cover enabling unlawful employment of a foreign national, being subject to international sanctions, and relevant tax-related criminal convictions. Where the applicable rules allow it, the tenderer may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The tenderer must be registered in the relevant business register in its country of establishment and provide the registration details or evidence if requested. Its total net turnover must have been at least EUR 40,000 in each of the last three completed financial years. If the information is not available in a public register, the tenderer must provide its annual accounts or relevant extracts when requested. During the 36 months before the procurement began—from November 2023 until the contract notice was published in the register—the tenderer must have completed or been performing at least two contracts for this service or a similar service maintaining public transport stop timetables. Each contract must be worth at least EUR 40,000 excluding VAT. The list must state the contract values and dates and identify the other contracting parties, including a contact person’s telephone number and email address; for public contracts, it must also include the procurement reference numbers. The bid must comply with the tender documents and may not be conditional. Its price must follow the required pricing structure. Where equivalence is relevant, the tenderer must explain it and provide supporting evidence. The tenderer must declare that it will not use, for more than 10% of the contract value, subcontractors or suppliers covered by the stated EU sanctions restrictions, and that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. Joint tenderers must appoint an authorised representative and include their power of attorney with the bid. The tenderer must identify and justify any trade secrets, but may not classify the bid price or other specified evaluation figures as trade secrets.
