Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must declare whether the bidder or its relevant representatives have convictions within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour or human trafficking offences. The bidder must also declare compliance with tax and social-security payment obligations, and confirm that it has not enabled unlawful employment of a foreign national. A bidder whose contract would breach an international or Estonian government sanction may be excluded. Participation is limited to bidders (including entities whose capacity they rely on) established in Estonia, another EU member state, another EEA contracting party, or a country party to the WTO Government Procurement Agreement; entities established in Russia or Belarus may not participate. Where an exclusion ground applies, the bidder may provide evidence of measures taken to restore its reliability where legally permitted.

Qualification criteria and exclusion grounds

The bidder must hold the permit or permits required to handle fecal wastewater when providing the service and must submit them before the framework agreement is signed. The person submitting or digitally signing the bid must be authorised to represent the bidder; a foreign bidder must provide evidence of that authority, and an authorised representative not recorded in the relevant register must be supported by a power of attorney using Form 1. Joint bidders must submit a power of attorney signed by all participants using Form 2 and are jointly and severally liable for contract performance. The bidder must identify authorised persons who are not visible in the relevant business register, or confirm that there are none. The bid must comply with the procurement documents, must not be conditional, and its price must follow the prescribed structure. Any claimed equivalence must be explained and supported by evidence. No specific financial-capacity or previous-experience threshold is stated in the provided documents.
