Compliance requirements
The tenderer must declare whether it or its representatives have relevant final convictions within the preceding five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and human trafficking. Exclusion grounds also include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, suspended business or comparable situations; serious professional misconduct; agreements intended to distort competition; conflicts of interest that cannot otherwise be prevented; involvement in preparing the procurement where an resulting competitive advantage cannot be eliminated; and significant or repeated failures under previous contracts that led to early termination, damages, price reductions or penalties. Grounds also cover false or misleading information, failure to provide required information or documents, improper attempts to influence the contracting authority or obtain confidential information, enabling the unlawful employment of a foreign national, entering into a contract in breach of international or Estonian sanctions, and relevant tax offences. Where permitted, the tenderer may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The tenderer must have properly completed at least three similar contracts during the 36 months preceding publication of the contract notice. Each client must have been a public-sector body or local authority. Similar work includes preparing a feasibility or cost-effectiveness analysis, study, strategic analysis or development document relating to waste management, the circular economy, environmental management or cooperation between local authorities. For each contract, the tenderer must provide information about its subject, value, dates, client, contact person and its own role. No specific minimum turnover requirement is stated.
The tender must include a team description and CVs using the contracting authority’s unmodified form, setting out each team member’s qualifications, work experience and completed work. It must also include a work plan and methodology describing the stages, approach and schedule for preparing the waste-management cooperation analysis. The tenderer must submit the participation application with confirmations and contact details using the supplied form, and present the price in the required structure. The offer must comply with the procurement documents; conditional offers are not permitted. If an equivalent solution is proposed, the tenderer must explain and substantiate its equivalence. Joint tenderers must appoint an authorised representative and submit an authorisation; they are jointly and severally liable for contract performance.
