Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder may be excluded if it or a person authorised to represent, manage or control it has a relevant final criminal conviction within the past five years, including for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour and human trafficking. Exclusion may also apply for unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, suspension of business or similar circumstances; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unavoidable competitive advantage; serious or persistent failures under previous public contracts; or false or misleading information, failure to provide required information or documents, or improper attempts to influence the procurement or obtain confidential information. National grounds also include enabling the unlawful employment of a foreign national, being subject to applicable international sanctions, and certain tax offences. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bidder must have completed at least two international digital marketing campaigns within the 36 months before the procurement was published. Each campaign must have been completed as a full-service assignment, with the bidder acting as the main contractor and providing project management, strategy and creative concept development, production and campaign implementation. Each campaign must have been worth at least EUR 50,000 excluding VAT. The bidder must provide a list of campaigns with their names, target countries, client contact details, contract and campaign start and end dates, value, target audience, a brief description, and the bidder’s role and tasks. The bidder must confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in Russia; entities more than 50% owned by such persons or entities; or persons or entities acting on their behalf or at their direction. A tender that would make the contract void under the applicable sanctions rules will be rejected. Joint bidders must appoint an authorised representative and include the relevant power of attorney with the tender. The tender must comply with the procurement documents; conditional tenders are not permitted. The bidder must submit the proposed solution for the first assignment, the “ICT sector campaign for the German market”, in accordance with the procurement documents. Any information claimed as a trade secret must be identified and the claim justified; tender prices and other specified evaluation-related numerical information may not be treated as trade secrets. No specific award criteria are stated in the provided documents.
