Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

Before signing the contract, the contracting authority will check the successful tenderer for the exclusion grounds under section 95(1) of the Estonian Public Procurement Act, using the public procurement register and sanctionsmap.eu. If the necessary information cannot be obtained through those checks, the successful tenderer must provide the relevant information or documents before contract signature. The tenderer and any joint tenderers must confirm that none of these exclusion grounds apply. Remedial measures under section 97 are accepted; where applicable, the tenderer must provide appropriate, reasoned evidence of those measures.

Qualification criteria and exclusion grounds

The tender must comply with the procurement documents and must be unconditional. It must remain valid for 3 months. The tenderer must prove that the manufacturer has authorised it to sell the licences covered by the contract in Estonia. Evidence may be a copy of a document or a link to the manufacturer’s or business partner’s website. Authorisation to represent the manufacturer throughout the European Union is also acceptable. If authorisation is established through a business partner, the tenderer must provide both confirmation from the manufacturer of the partner’s authorisation, or a link to the manufacturer’s website, and confirmation from the partner of its cooperation with the tenderer, or a link to the partner’s website. The tenderer must provide the contract signatory’s name, authority to sign and job title, as well as the name, job title, telephone number and email address of the contract-performance contact person. The tenderer’s bank account number must also be provided. For persons authorised to represent, make decisions for or control the tenderer whose details are not recorded in the business register, the tenderer must provide their first and last names, personal identification number and the basis of their authority. The tenderer, any joint tenderers and subcontractors must be established or domiciled in Estonia, another EU Member State, a state party to the European Economic Area Agreement, or a country party to the World Trade Organization Agreement on Government Procurement. Joint tenderers must appoint an authorised representative from among themselves and submit a power of attorney. After the contract is signed, the tenderer must provide the name and registration number of each subcontractor, and the title, date, number and value of the subcontract, where its value excluding VAT exceeds EUR 50,000. The same information must be provided for subcontractors added during contract performance. The tenderer must identify any trade secrets in the tender and explain why they qualify as such. The tender price and figures corresponding to the award criteria may not be designated as trade secrets. The tenderer must confirm that its tender complies with the procurement documents and, where relevant, explain equivalence and provide supporting evidence. For objective reasons, other relevant evidence of equivalence may be accepted. The tenderer must confirm that the goods offered are not subject to international sanctions and do not originate from sanctioned regions. The provided document states no turnover or previous-experience requirements and no award criteria.
