Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must confirm that no mandatory exclusion ground applies. These grounds cover convictions of the bidder or a person authorised to represent, manage or control it for participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorist offences or related conduct, money laundering or terrorist financing; offences involving the unlawful employment of a foreign national or violations of the conditions for employing a foreign national in Estonia, including payment below the statutory wage rate; child labour or human trafficking; and outstanding state tax, duty or environmental charge liabilities, or tax or social security contribution debts under the law of the bidder’s country of establishment. The contracting authority may also exclude a bidder for a substantial or repeated breach of an important term of a previous public contract that led to termination, withdrawal, a price reduction, compensation or a contractual penalty. It may also exclude a bidder that provided false information about compliance with qualification conditions or failed to provide such information or requested supporting documents.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement; at least one contract must be worth €40,000 or more excluding VAT. The bidder must provide a list stating each contract’s performance period, the other contracting party’s details (including the customer representative’s telephone number and email address) and, for public contracts, the procurement reference number. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from public or private databases without significant cost. The bid must include the price table using the prescribed form, with every unit-price field completed, and take account of the instructions for management-system document V178. The bidder must have an electrical works manager with a valid A-class competence and/or a qualification of at least level 6 under the Vocational Qualifications Act. The person must hold the relevant evidence by the bid submission deadline and be registered in the EPP environment before bids are opened. The bidder must have a worker with switching rights for the switching operations required for the works in the 0.22–20 kV electricity network, excluding regional and distribution substations. The worker must be registered in the EPP environment before bids are opened, and the rights must be obtained in accordance with document J387. For works limited to low voltage (0.22–1 kV), at least low-voltage switching rights are required. In other cases, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side (over 1–20 kV). The bidder must also have a person designated as responsible for the work operation (C-person), registered in the EPP environment before bids are opened; the relevant rights are governed by documents J31 and J3284. The bidder must provide the name, position and contact details of each contract signatory, evidence of the signatory’s authority and details of the contract-performance contact person. A power of attorney must be included if the authority to represent the bidder does not arise from its articles of association. The bidder must identify and justify any information claimed as a trade secret; prices and other bid information used for evaluation may not be classified as trade secrets. The bidder must confirm that it is not established or resident in Russia or Belarus. Materials, equipment and goods used in the works, including components, must not originate from or be produced in Russia or Belarus; the contracting authority may request certificates of origin. Standard payment terms, calculated from receipt of the invoice, are 14 calendar days for contracts up to €59,999, 35 days for contracts from €60,000 to €249,999, and 45 days for contracts of €250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment term. No award criterion is specified in the provided documents.
