Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must confirm that none of the exclusion grounds under § 95(1), points 1–5 of the Estonian Public Procurement Act apply. These grounds cover specified convictions of the bidder or its authorised representatives for participation in a criminal organisation, breaches of integrity or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences involving unlawful employment of foreign nationals or payment below the statutory minimum wage; offences involving unlawful child labour or human trafficking; outstanding taxes, duties or environmental charges, or tax or social security contribution debts under the law of the country of establishment; and contract award that would breach an international or Estonian government sanction.

Qualification criteria and exclusion grounds

The bidder must be entered in the commercial register of its country of establishment where required by that country’s law. A bidder established in Estonia does not need to submit a copy of its registry record. The bidder and/or its subcontractor must have completed at least one contract during the 36 months preceding the start of the procurement for the design, at preliminary, detailed design or working design stage, of a fuel supply system for an industrial technological facility or system. The bidder must submit Form 2, listing the relevant contract’s name, brief description, performance period and other contracting party. Where the bidder relies on another entity’s resources or references, it must identify that entity and the qualification requirement concerned, demonstrate that the resources will be available for contract performance, and provide supporting evidence. An entity whose experience is relied upon must perform the part of the contract for which that experience is required. For a joint bid, the members must appoint an authorised representative and provide a power of attorney. The bid must accept all conditions in the procurement documents; conditional bids are not permitted. The bidder must confirm compliance with the requirements and explain any claimed equivalence, with supporting evidence where necessary. Any business secrets must be identified and justified; the bid price and other numerical values used in evaluation may not be designated as business secrets. The bidder must disclose any participation in preparing the procurement or other circumstances that may have given it an unequal competitive advantage, and any known circumstances indicating a conflict of interest on the contracting authority’s side. If subcontractors are planned, the bidder must state the share and nature of the subcontracted work and identify known subcontractors by name and registration code. The price must follow the structure in the evaluation and priced-indicators schedule, and Form 1 (Bid Form) must be completed in all highlighted blank fields without deleting rows. The notice does not specify the award-scoring method.
