Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder may be excluded if it, or a person in its management, administrative or supervisory body or authorised to represent or control it, has a relevant final conviction within the preceding five years, or remains subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. Where permitted for this procurement, the bidder may provide evidence of measures taken to restore its reliability. Exclusion grounds also include outstanding tax or social security payment obligations, enabling a foreign national to work unlawfully or breaching the conditions for their employment (including paying below the prescribed wage rate), and a proposed contract award that would breach an international or Estonian government sanction. The bidder must provide the relevant confirmations and information. The tender documents also require confirmation that no subcontractor subject to replacement under the applicable exclusion rules will be engaged during contract performance.

Qualification criteria and exclusion grounds

The bidder must be entered in the relevant professional register in its country of establishment; the specified register is the Commercial Register. The bidder’s average annual net turnover for 2023–2025 must be at least EUR 1,500,000, corresponding to a minimum total of EUR 4,500,000 over the period 1 January 2023 to 31 December 2025. During the 60 months preceding the start of the procurement, the bidder must have constructed and/or reconstructed a cumulative total of at least 5.0 km of public water supply and/or sewerage pipelines under at least one construction contract. The bidder must list qualifying contracts in the ESPD; the successful bidder must provide evidence of proper completion when requested. A contract awarded earlier may count if the works were completed within the stated 60-month period. The person responsible for managing construction works (the project manager) must hold at least a Level 7 certified water supply and sewerage engineer qualification, or an equivalent EQF qualification, specialising in external water supply and sewerage and competent to manage construction activities in those fields. The bidder must identify this person in the ESPD and provide qualification evidence upon request. The person may be employed by the bidder or engaged as a subcontractor. The bid must include the completed Tender Form II, Bid Annex Form III and price list, and prices must follow the structure specified in the pricing schedule. The bid must be signed by the bidder’s legal or authorised representative; an authorised representative’s power of attorney must be included. Joint bidders must appoint an authorised representative and provide their power of attorney. Conditional bids are not permitted, and submitting a bid confirms acceptance of the tender-document requirements. The bidder must identify and justify any information claimed as a trade secret; the bid price and price components, and other figures or indicators used for evaluation, may not be designated as trade secrets. The bidder must confirm that it will not engage a subcontractor who is subject to replacement under the applicable rules. Where equivalence is relevant, it must be explained and supported with evidence. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. The supplied document extracts do not specify the detailed award criteria.
