Provision of technical maintenance and repair services for frequency converters

The bidder must confirm that none of the exclusion grounds under § 95(1), clauses 1–5 of the Estonian Public Procurement Act applies. These grounds include relevant convictions of the bidder or its representatives for criminal organisation, breach of official duties, corruption, fraud, terrorism, money laundering or terrorist financing; enabling unlawful employment or underpayment of foreign workers; unlawful use of child labour or human trafficking; outstanding state taxes, duties or environmental charges, or social security contributions; and circumstances where awarding the contract would breach an international or Estonian government sanction. The bidder must also disclose any circumstances that could indicate a conflict of interest or distortion of competition, including involvement in preparing the procurement or receiving information unavailable to other bidders. If such circumstances exist, the bidder must submit a free-form explanation identifying the person involved, the relationship and the information or other relevant circumstances. The bidder must confirm that, to its knowledge, no conflict of interest exists on the contracting authority’s side and that neither it nor a related person has gained an undue competitive advantage through involvement with the contracting authority. Any relevant explanations must be submitted with the tender.

The bidder must be registered in the commercial register or an equivalent register in its country of establishment where such registration is legally required. A foreign bidder must provide a valid copy of the relevant registration certificate if applicable. Within the 36 months preceding the start of the procurement, the bidder and/or its subcontractor must have properly completed at least one significant contract involving the technical maintenance, repair and fault prevention of frequency converters, with a value of at least EUR 50,000 excluding VAT. The value of several contracts may not be combined. Only services properly performed and accepted within the relevant reference period are counted. The bidder must submit the completed Contract List form, including the contract name, client, value excluding VAT, performance period, description of the work and the client’s contact details. The contracting authority may verify the information with the client and request additional evidence. If the bidder relies on another undertaking’s experience, that undertaking must personally perform the part of the contract for which its experience is relied upon. The bidder and/or its subcontractor must also have properly completed, within the same preceding 36-month period, at least one significant contract involving the technical maintenance, repair and fault prevention of frequency converters with a capacity above 100 kW. The bidder must submit the relevant Contract List form and the required supporting information. The same rules apply to the use of another undertaking’s experience. The bidder must have qualified responsible persons for the works, including an electrical works supervisor with at least Class A competence, an electrical works supervisor with at least Class B competence, and a person responsible for the works holding a valid certificate proving completion of “VFD basic service and repair” training from at least one of the following equipment manufacturers: ABB, Mitsubishi, Schneider Electric, Siemens, Converteam, Grundfos or KSB. The bidder must submit the list of responsible persons and copies of documents proving their qualifications and competence. A foreign bidder without documents issued under Estonian regulations must provide equivalent documents issued under the law of its country and undertake to submit, within one month after signing the contract, confirmation issued by the Estonian Consumer Protection and Technical Regulatory Authority. The tender must comply with all procurement documents and may not be conditional. The tender price and cost calculation must follow the specified structure and be submitted using the required calculation form. The bidder must confirm compliance with the requirements, explain and document any proposed equivalent solution where necessary, and identify and justify any business secrets; the tender price and other prohibited numerical evaluation data may not be classified as business secrets.
